摘  要：D的十八大提出“老虎苍蝇一起打”等治理腐败的口号，表明了反腐败的决心，也指明了对待腐败的态度---“零容忍”。而现今的理论界对在我国能否实现“零容忍”，持有不同的态度。说能实现的有能实现的理由，说不能实现的有不能实现的依据。从其非普适性、与犯罪理论不符、成本巨大、易生异化等方面分析，腐败犯罪“零容忍”是不可行的。但不可行，并不代表没有积极作用。而且“零容忍”作为我国反腐的一项新的刑事政策，又需要刑事法律来体现。因此我国刑事法律在坚持罪刑法定原则的基础上，吸收“零容忍”反腐的积极内核是很有必要的。40118
