摘要当今社会经济发展迅猛，驰名商标在经济发展中的地位日益凸显，其承载着巨大的商业价值。我国传统上是采用注册取得商标权的原则，对注册商标和未注册驰名商标的保护存在差别。在未注册驰名商标的保护上仍未形成一套完整的法律保护体系，保护力度相对薄弱。这容易让不法商家利用法律的漏洞来侵害商标权益人的利益，破坏市场竞争秩序。另外国际上对未注册驰名商标的保护越来越重视，国内市场竞争也要求进一步研究如何更好地保护未注册驰名商标，维护多方的权益，打造良好有序的市场环境。本文的研究思路是以未注册驰名商标的法律保护为主线，在阐述当前未注册驰名商标的发展、保护趋势及其概念的基础上，提出保护的必要性，进一步分析我国目前在这方面的侵权现状、立法现状和司法现状，总结出当前存在的问题，然后比较分析国际公约对未注册驰名商标的法律保护规定，简要介绍美国的反淡化保护机制。最后，充分结合中国国情，尝试对我国未注册驰名商标的法律保护提出几点建议，以构建完整的法律保护体系。45569

Abstract
…Nowadays, with the rapid development of social economy, well-known trademark occupies a more and more highlighted position in society with huge commercial value. However, the principles of trademark registration are used in China traditionally, and there is a difference between the registered trademark and the unregistered well-known trademark protection. The legal protection of unregistered well-known trademark still has not formed a complete system, which leads to a relatively weak one. As a result, it is easy for illegal businessmen to use loopholes in law to infringe on the interests of trademark rights of customers as well as to destroy the order of market competition. In addition, the unregistered well-known trademark protection are being paid more and more attention from all over the world while the domestic market competition also requires further study on how to better protect the unregistered well-known trademark, safeguard the rights and interests of people involved, and help develop an orderly market circumstance. This research sets the unregistered well-known trademark legal protection as the main line, and reveals the necessity of protecting the unregistered well-known trademark basing on its current development, tendency and basic concept. And the further analysis of the present tort situation, legislation and judicial situation in our country is made. What’s more, the author sums up the existed problems, and compares the international conventions on the legal protection of unregistered well-known trademark by giving a brief introduction on American protection mechanism. Finally, focusing on the national conditions of China, the author tries to offer some suggestions on how to protect the unregistered well-known trademark in law and complete the legal protection system.
