摘要：“代驾”在我国得以发展的原因绝大多数来自于“酒驾入刑”。2011年5月1日“醉驾入刑”致使新的道路交通安全法的出台，使代驾过程中产生的法律问题得到全社会的关注。“代驾”这一新兴行业高调出现在我们的视野里,因此对其进行法律分析，了解代驾合同的性质，明确代驾责任的承担，正视我国代驾存在的法律问题，提出代驾的法律规制建议，对于代驾行业的发展有着极其重要的意义。39841

A Brief Analysis about the Legal Issues of the Generation of Driving
Abstract：The foundation of the development of generation of driving mostly due to the drunk driving into the punishment. With the drunk driving put into the punishment on May 1,2011, it lead to the subsequent new road safety law, which makes the whole society put much attention on the legal issues in the process of generation of driving. As a emerging industry, generation of driving is in our field of vision with a high profile. So it is highly significant to the development of generation of driving industry to analysis it in a legal way, to comprehend the nature of the generation of driving in contract, to make the responsibility clear of the generation of driving, to confront the legal issues of the generation of driving in China, also to put forward some suggestions of legal regulation of the generation of driving.

（一）代驾的概念
在中国历史文化漫长的发展过程中，酒文化一向占有极其重要的地位，无酒不成宴席成为传统，酒文化已经成为一种餐桌礼仪。汽车给我们的生活带来许多的便利，也给我们带来了许多的烦扰。每当逢年过节、商务谈判，喝酒应酬都是不可避免的，酒后驾车问题也随之产生，酒驾给人们生活带来的损害更是不言而喻。国家为了保护人民的财产生命安全，在《刑法修正案（八）》和《道路交通安全法》中对其酒驾行为可能引起的法律问题给予相应的惩罚。据媒体报导，上海市工商部门宣布，从2009年9月10日起开始受理“代驾公司”的登记注册申请，这是最早出现的代驾情形。一面是违法可能面对的交通事故的处分责罚，另一面是交际不得不喝酒的无可奈何，因此“代驾”这一新兴行业应市场需求而生。
