摘  要：律师在诉讼中承载着举足轻重的地位，法律虽然赋予其相当充分的权利，但是仍有不足且在实践中律师权利在诉讼各阶段的保障仍差强人意。在此背景下，探讨其权利不够完善的深层原因，同时考察国外律师权利保障制度，进一步大胆探索相应改革策略就成为不可回避的重要课题。本着充分实现刑事诉讼的目的和诉讼价值，为有效辩护提供绵薄之力的愿望，笔者提出构建律师权利保障机制的观点进行相应的分析。34277

The Mechanism of Protecting Lawyer’s Litigation Rights under Effective Defense
Abstract: Lawyer plays a pivotal role in the lawsuit, they have many rights according to the law, but in practice there are still flaws, and the protection of Lawyer’s rights is still unsatisfactory at all stages of the proceedings. In this context, to investigate the underlying causes of the right is not perfect, at the same time to explore foreign lawyer rights protection system, then boldly explore further reform strategy accordingly, has become an important issue which can not be avoided. In order to achieve the full realization of the purpose and value of criminal litigation proceedings, and to provide tiny help for effective defense. I propose to build lawyer rights protection mechanism and make corresponding analysis.
